PROF. RAFAŁ SIKORSKI SPEAKS AT AN INTERNATIONAL PATENT CONFERENCE IN MUNICH

Prof. Rafał Sikorski gave a lecture entitled “Global convergence of approaches towards injunctive relief in patent law: achieving flexibility via different legal tools” at an international patent conference “Injunctions and flexibility in patent law” in Munich, Germany.

The event attended by a group of experienced specialists – researchers and practitioners from Europe, the US and Asia – was hosted by the Ludwig Maximilian University of Munich.

The participants  discussed patent legislation across jurisdictions.

‘Traditionally, in many states default claims were allowed by courts almost automatically if an intellectual property rights infringement was identified’, says Prof. Sikorski of SMM Legal.

‘However, recently patent disputes highlighted the problem of default claims abuse by parties who leverage the claims in negotiations to obtain licensing fees much higher than the value of the protected rights. Patent trolls, patent assertion entities or privateers are often refused injunctive reliefs in the form of cease and desist orders regarding the patented solution’.

The experts attending the conference discussed this and many other pertinent intellectual property issues.
