An article written by experts from the SMM Legal Intellectual Property Team, Ms. Magdalena Michalska and Ms. Joanna Matczuk, entitled W jaki sposób można skutecznie obronić autorski pomysł (How to Effectively Protect an Original Idea) was recently published in the leading Polish daily newspaper, Rzeczpospolita (Rzeczpospolita of 03/03/2017, p. D4).
Referencing selected case law, the authors discuss the difference between unprotected ideas that exist in the public domain, and copyrighted creative expressions. The article also explores the difficulties inherent in the protection of ideas, suggesting possible solutions that draw on intellectual property law and the law on preventing unfair competition.
