On 04 November, the TVN24 news channel aired a report on a case (which it also posted on its website) which outraged the public in Poznań and elsewhere in Poland: a mother who regularly abused alcohol while pregnant gave birth to a drunk baby. Mr. Przemysław Maciak, partner at SMM Legal, provided his expert commentary on the impunity of such behaviour.
Legal regulations in Poland and in Europe do not stipulate any punishment of pregnant women for drinking and offer no instruments for interventionin this respect. Mr. Maciak emphasized the conflict between the personal freedom of the mother-to-be and the harm done to another (unborn) human being, pointing out that the issue lies in the overlap between the domains of philosophy and law.
