Final resolution of a dispute concerning the performance of a multi‑million‑złoty contract for the banking sector

Attorney‑at‑law, Jan Stranz, PhD, successfully represented one of the largest Polish banks before the court in a dispute with a market leader in logistics and financial services.

The case concerned the interpretation of contractual provisions governing the rules for calculating remuneration for services with a value of several million Polish zloty (PLN).

The Regional Court in Poznań fully upheld the arguments presented by SMM Legal. In particular, it indicated that the risk arising from imprecise wording of contractual provisions rests with the party that prepared the draft agreement.

“The judgment shows how important it is to look after the client’s interests already at the stage of negotiating the terms of the contract. Its interpretation years later may become the subject of a court dispute,” emphasises Attorney‑at‑law, Jan Stranz, PhD, Partner at SMM Legal.

The opposing party ultimately refrained from lodging an appeal, as a result of which the judgment became final and binding.
