On the 12th of September 2017, the ‘Panorama’ news show on TVP2 aired a segment dedicated to precedent court and arbitration actions brought by ENERGA-Obrót S.A.
SMM Legal is representing the Company in proceedings to declare the invalidity of framework agreements on the sale of proprietary rights under certificates of origin for electricity generated by wind farms (so-called green certificates). Prof. Maciej Mataczyński, Managing Partner at SMM Legal, commented on the recent legal steps taken by ENERGA-Obrót S.A. He emphasized the fact that, at the time the framework agreements were made the Company was a utility provider, and in consequence public procurement law was applicable to the acquisition of the green certificates.
