On 18 March 2015 Jarosław Bełdowski, partner at SMM Legal, appeared on-air on TOK FM’s EKG show. Guests discussed the draft act amending the Tax Law and certain other acts.
Due to the vastness of the new proposals, the debate focused on key assumptions that underpin the amended Tax Law, including taxpayer protection and the rule of weighting the interest of parties to the tax relationship. Another important rule is the in dubio pro tributario principle, pursuant to which all potential doubts are settled in favour of the taxpayer. Mr. Bełdowski emphasized that this is one of the most important and long-awaited changes. Another topic discussed on the show was mediation in tax procedures. Mr. Bełdowski argued that this solution is beneficial to all parties and helps to bridge the sense of disparity. However, the proposed law is not free of worrying aspects – Mr. Bełdowski pointed to the tax clerk’s position, mainly the trust relationship between the clerks and their superiors, as well as accountability for their actions. A clerk should always act with the conviction that whatever steps they take, they have chosen the right path.
