Ms. Michalska-Niewiadomska is a professional EUIPO Representative. She specialises in the protection of intellectual and industrial property, focusing on copyright and related rights, as well as trademark protection. In her daily work, she drafts and negotiates IT&IP contracts, such as implementation agreements (including those based on Waterfall or Agile methodology), software licensing agreements, service contracts or source code escrow agreements. She provides ongoing advisory to clients in the area of personal data protection.
She has represented clients in disputes concerning copyright infringements, unfair competition practices, infringement of moral rights and trademark protections before Polish common courts and the Supreme Court.
What is more, she has experience in handling disputes concerning trademark infringement by registration and use of internet domains before specialist arbitration tribunals for internet domains, including the Arbitration Tribunal for Internet Domains at the Polish Chamber of IT and Telecommunications in Warsaw or the WIPO Arbitration and Mediation Center.
Ms. Michalska-Niewiadomska holds a degree in law awarded by the Cardinal Stefan Wyszyński University in Warsaw. She is a licensed attorney, enrolled with the Regional Bar in Katowice (she passed her bar exam cum laude). In 2017 she completed a postgraduate programme on the roles of Information Security Administrator and Data Protection Officer organised by the Institute of Legal Sciences of the Polish Academy of Sciences in Warsaw. From 2020, she is a member of the Association of Data Protection Practitioners.
